Overview

These conditions of sale are concluded on the one hand:

- "Lunes" - whose registered office is at 21 rue des Vignerons, 11200 Luc sur Orbieu, and registered under number SIRET: 48432485000011, hereinafter referred to as "LUNES",

- and on the other hand, by any natural or legal person wishing to make a purchase on the website of "madeinoccitanie.com" hereinafter referred to as "the buyer".

The present conditions of sale aim at defining the contractual relations between LUNES and the purchaser and the conditions applicable to any purchase made through the commercial site of "madeinoccitanie.com", that the purchaser is professional or consumer.

The acquisition of  goods or a service through the site entails the unconditional acceptance of these conditions of sale. The buyer therefore declares to have read it at the time of placing the order.

These conditions may be modified at any time without prior notice by LUNES. However, these changes will only apply to orders made after posting. These conditions of sale will prevail over all other general or special conditions not approved by LUNES.

 

Products

The creations proposed within LUNES and the site "madeinoccitanie.com" are craft creations. Because of this, each is unique and the product ordered may differ slightly from the picture presented on the site. Each item is sold within the limits of available stocks. In each description, you will find information about the availability of the product or raw materials, the stock and, in the event of it being made or being out of stock,  the time required to order the products and manufacture the item. As many of them are customizable upon request, a manufacturing lead time may be required. In this case it is indicated on the sheet but do not hesitate to contact me in case of question concerning your order.

Some products are available on a bespoke exclusive basis. In case of order of one of these products already sold (in case of malfunction of the shop if two orders are placed simultaneously before the automatic update of stock, for example), the customer who ordered the item first (date and time of the order as proof) will see only his order validated. The second will be refunded his order or offer an equivalent product if one exists

 

 

 

Prices

The prices posted on the site "madeinoccitanie.com" are in euros, all taxes included. They do not take into account the delivery costs, invoiced in addition, and indicated during the finalization of the order.

LUNES reserves the right to modify its prices at any time, in particular because of the price variation of its own suppliers. However, it is understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.

Orders

LUNES reserves the right to cancel any order from a buyer with whom there is a previous dispute.

Any order is irrevocable for the buyer subject to the application of the statutory withdrawal period of 14 working days.

You can also make any other declaration without ambiguity, expressing the will to retract (Article L. 121-21-2 of the Consumer Code) An acknowledgment of receipt will be sent to the buyer as soon as possible ( email or mail) to inform him of the successful receipt of his request for withdrawal. The refund of the goods will be made within 14 days of receipt of withdrawal request, by the same means of payment as the one used to buy it to pay for the order, or by other means of payment after approval. the buyer. The refund may be deferred until receipt by LUNES of the goods. The cost of return are the responsibility of the buyer, the shipment to be made under the conditions of shipping similar to that previously used by order to ship the package. The buyer undertakes to return the products no later than 14 days after the communication of his decision to retract, unless LUNES proposes to recover the property himself (Article L. 121-21-3 al 1 of the Consumer Code) .The buyer may test the product but will be liable in case of depreciation of goods resulting from handling other than those necessary to establish the nature, characteristics and proper functioning of these goods (Article L 121-21-3 paragraph 3 of the French Consumer Code).

For any item made to measure with choice of options by the customer, the right of withdrawal can not apply, in accordance with the provisions of Article L 121-20 of the Consumer Code as amended by Ordinance No. 2001 -741 of August 23, 2001. The retraction is in particular excluded (article 121-20.2 paragraph 3) for contracts for the supply of goods that are clearly personalized or made to the consumer's specifications, including tailor-made items.

By confirming his order, the buyer accepts the entirety of the present general conditions of sale, and recognizes to have a perfect knowledge of it and the renunciation to take advantage of its own conditions of purchase or other conditions. All the data provided and the recorded confirmation will be worth proof of the transaction and acceptance of the operations carried out.

In case of non payment of the order within 2 (two) weeks following the passage of said order on the site, it will be considered void and will be automatically canceled.

Payment terms

Payment for purchases is done as soon as the order is finalized. Payments are made either:

• By credit card via the secure system SumUP- immediate and highly secure electronic payment interface. Pay with confidence with your credit card thanks to SumUP. Valid for all customers, French or foreign.

• By bank transfer in Euros  The payment information will be communicated to you during the finalization of your order Valid for all customers, French or foreign.

 

For custom orders (barrel art) please contact Lunes directly. An estimate will be sent to you with a deposit of 30% to be paid upon signature. The remaining 70% is to be paid at the end of the product's manufacture, before shipment. The possible means of payment are the same as for the orders of products from the catalog.

Delivery - Shipping Costs

Shipping is based on a flat rate fee. This means that you can group several items of the same nature (Jewellery or Wine Barrel Art)  together and pay only one price. 

Shipping charges applied on the site do not take into account any customs fees or taxes related to the country of destination. The buyer is responsible for the customs fees. Shipping costs include packing, handling and postage. They contain a fixed part corresponding to handling and packaging costs (cardboard, bubble wrap, foam etc.).

We use a range of different shipping providers.  

Unless otherwise specified, delivery is made to the address specified by the buyer when ordering. In case of error on the part of the buyer in the address of the recipient, LUNES can not be held responsible for the impossibility of delivering the product to the right destination.

LUNES undertakes to communicate to the buyer by e-mail the information concerning the delivery of his purchase as soon as the order has been completely finalized and the payment has been credited to the seller.

In case of damage during transport, a claim must be made to the carrier upon receipt of the shipment. LUNES can not be held responsible for any damage, loss or theft of parcels by the carrier. The delivery method followed allows tracking of your parcel during its delivery. In case of problems with this routing, loss or theft, a new package will be returned if the items are still available or a refund will be made if it were single items or non-reproducible copies. Attention, no package will be returned or refunded if the tracking site indicates that the package has been delivered to the recipient. The parcel return or refund applies only in case of problem delivery, reported specifically on the tracking site.

Dispatch Time

Unless otherwise specified (expressly sent to the buyer or absence message announced on the website), shipments are usually made within 2 - 5 business days  from the receipt of payment and validation of the order.   Some objects require a longer manufacturing time. In this case, the buyer is systematically notified by email.

Retraction and returns
In accordance with Article L. 121-21 of the Consumer Code, the buyer has a period of 14 working days from the date of delivery of his order, to return any item which does not suit him and ask the an exchange or refund without penalty, with the exception of the return costs which will be at his own expense.

However, please note that:

- The return must be done after agreement between LUNES and the buyer. For this, thank you to send an email expressing the will to retract (Article L. 121-21-2 of the Consumer Code) The buyer agrees to return the products no later than 14 days following the communication of its decision to retract unless LUNES proposes to recover the property itself (Article L. 121-21-3 paragraph 1 of the Consumer Code).

- The package must be returned to the personal expenses of the buyer under the same conditions of shipment and protection as when shipping by LUNES.

- Articles must be complete, intact and unpacked, always in their original packaging.

LUNES provides a menu selection system by drop-down menu to allow the buyer to customize his ordered items. In case of error or forgetfulness on the part of the buyer during the personalization of the creations, the return of items and their return will be at the expense of the buyer within the statutory period of 14 days. In no event will LUNES be held responsible for these omissions and no refund will be made for this reason.

 

Warranty of current products and services
LUNES jewellery is guaranteed for 3months against any defect in design and material from the date of purchase.

This warranty applies to defects in workmanship. The buyer is solely responsible for the choice of products, their conservation and their use. LUNES can not be held responsible for damage of any kind, both material and immaterial or bodily, that could result from misuse of the products marketed.

However, given the personal and particular nature of objects where personalization is requested no refund can be made on these objects.

LUNES will not be considered responsible or defective for any delay or non-performance resulting from the occurrence of a force majeure usually recognized by French case law (unavailability of the product, force majeure, disruption or total or partial strike including postal services and means of transport and / or communications, flood, fire).
